Please read these terms carefully before using Spicy Studio. By using our service, you agree to be bound by these terms.
1. Acceptance of Terms
By accessing or using Spicy Studio ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to all of these terms, you may not access or use the Service. We reserve the right to update these terms at any time, and continued use of the Service constitutes acceptance of any modifications.
2. Account Registration & Age Requirements
To access certain features of the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information during registration and keep your account information up to date. You must be at least 13 years of age to use this Service (or the minimum age required in your jurisdiction). You must be at least 18 years of age (or the age of majority in your jurisdiction, if higher) to access or use any mature, uncensored, or “spicy” features and models described in Section 6. By using those features you confirm that you meet this requirement and that viewing and creating such content is lawful where you are located.
3. Credits & Payments
The Service operates on a credit-based system. Credits are purchased through subscription plans or one-time top-ups. All purchases are final and non-refundable unless required by applicable law. By completing a purchase, you consent to immediate access to the digital service and acknowledge that you waive your 14-day right of withdrawal under the EU Consumer Rights Directive once credits are used. Subscription credits reset at each billing cycle and do not roll over. One-time credit purchases do not expire. Prices are subject to change with reasonable notice.
4. Role of Spicy Studio — Intermediary Between You and AI Providers
Spicy Studio is a technology intermediary. When you submit a prompt, upload, or other input, Spicy Studio forwards your request, on your behalf and on your instructions, to the third-party AI model providers listed in Section 7, which generate the output. Spicy Studio does not author, select, edit, or review the content of individual prompts or outputs, does not exercise editorial control over them, and is not the publisher or speaker of any content you generate. You — the user who submits the request — are the initiator of every generation and are solely responsible for it. Fees you pay cover access to the Service and the onward procurement of generation capacity from these providers. Nothing in these Terms makes Spicy Studio a co-author, partner, or joint controller of the content you create.
5. Acceptable Use & Prohibited Content
You agree not to use the Service to generate content that: (a) violates any applicable law or regulation; (b) infringes on the intellectual property rights of others; (c) depicts, sexualizes, or exploits minors in any way — the generation of child sexual abuse material (CSAM), child exploitation imagery, or any sexualized content involving minors or persons who appear to be minors is strictly prohibited and will result in immediate account termination and reporting to the relevant authorities (including NCMEC); (d) constitutes non-consensual intimate imagery or deepfake pornography of real individuals; (e) constitutes harassment, threats, or hate speech directed at real individuals; (f) is used for deception, fraud, or impersonation for malicious purposes; (g) generates realistic images of identifiable real persons without their consent; (h) promotes terrorism, extreme violence, or self-harm; (i) depicts sexual violence, bestiality, or non-consensual sexual acts. We employ automated content moderation systems to detect and block prohibited content. We reserve the right to terminate accounts that violate these policies without refund and to cooperate with law enforcement where required.
6. Mature ("Spicy") Content
Certain models on the Service (including "Spicy UNCENSORED", "Spicy UNCENSORED Video", "HappyHorse 1.1", and "Wan 2.7 Image") permit mature, uncensored, adult-themed ("spicy") content involving fictional adults or consenting adults. These features are available only to users who meet the age requirement in Section 2. Such content must depict adults only, must never depict real, identifiable persons without their documented consent, and remains subject to every restriction in Section 5. Generations are private to your account by default. If you choose to share, publish, sell, or distribute such content, you alone are responsible for complying with all laws that apply to you and to your audience, including age-verification, labelling, record-keeping, obscenity, and platform rules. Spicy Studio does not endorse any content generated with these models.
7. AI Models & Third-Party Services
The Service utilizes AI models developed and operated by third parties, accessed through third-party API providers. Some models are presented under Spicy Studio product names for ease of reference; these names are branding only and do not represent claims of proprietary model development. In particular: "Spicy UNCENSORED" is powered by ByteDance's Seedream 5.0 image model (offered as Pro, Flash, and Lite versions); "Spicy UNCENSORED Video" is powered by Alibaba's Wan 3.0 video model; and "Spicy Imagine Pro" is powered by ByteDance's Seedream image models. Other models, such as HappyHorse 1.1 and Wan 2.7 Image (Alibaba), Seedance (ByteDance), Kling, Veo, GPT Image and Nano Banana, are presented under their own names. The underlying models remain the intellectual property of their respective creators and are used in accordance with their licensing terms. We do not guarantee the availability, accuracy, or quality of any specific model. Models may be updated, replaced, or removed at any time, and the model behind a Spicy Studio product name may change. Generation results may vary and are not guaranteed to match expectations. We are not responsible for the output of third-party AI models.
8. Generated Content, Ownership & Responsibility
Content generated through the Service is owned by you, subject to the underlying model licenses and these Terms. Each user is solely and fully responsible for the prompts, images, videos, audio, and other inputs they submit and for every output generated from them, and bears full legal responsibility and liability for all content they generate, store, distribute, publish, or otherwise make available using the Service. You are responsible for ensuring that your inputs and generated content comply with all applicable laws and regulations in your jurisdiction, including but not limited to intellectual property, privacy, personality and publicity rights, defamation, and obscenity laws, and that you hold all rights and consents needed for anything you upload. You grant Spicy Studio a non-exclusive, worldwide license to use generated content for service improvement, marketing, and promotional purposes unless you opt out; Spicy Studio will not use content generated with the mature (“spicy”) models described in Section 6 for marketing or promotion. Spicy Studio acts solely as a technology intermediary and is not liable for any consequences, claims, damages, or legal actions arising from your use, distribution, or publication of generated content.
9. Indemnification
You agree to indemnify, defend, and hold harmless Spicy Studio, its operators, employees, and partners from and against any claims, liabilities, damages, losses, fines, and expenses (including reasonable legal fees) arising out of or related to: (a) the prompts, uploads, and other inputs you submit; (b) the content you generate, store, share, publish, or distribute through or from the Service; (c) your violation of these Terms; or (d) your violation of any law or the rights of any third party, including intellectual property, privacy, and publicity rights.
10. Creator Program
Participation in the Creator Program ("Invite & Earn") is subject to additional terms. Views are verified through our automated watermark detection system. Spicy Studio reserves the right to adjust earning rates, disqualify fraudulent views, and terminate program membership for policy violations. Earnings are calculated monthly and paid within 15 business days of the calculation date.
11. Privacy & Data
Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of your data as described in the Privacy Policy. Prompts, uploaded images and other inputs, and generated content are transmitted to and processed by the third-party AI providers described in Section 7, subject to their respective privacy policies.
12. Limitation of Liability
The Service is provided "as is" without warranties of any kind. Spicy Studio shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, or for content generated by you through third-party AI models. Our total liability shall not exceed the amount you have paid to Spicy Studio in the twelve months preceding the claim.
13. Termination
We reserve the right to suspend or terminate your account at any time for violation of these terms or for any other reason at our sole discretion. Upon termination, your right to use the Service ceases immediately. Any unused credits will be forfeited upon termination for cause. You may terminate your account at any time through your account settings.
14. DMCA & Copyright
Spicy Studio respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA). If you believe your copyrighted work has been infringed, please visit our DMCA Policy page at spicystudio.io/dmca for instructions on filing a takedown notice. We may terminate accounts of repeat infringers.
15. AI-Generated Content
All content generated through the Service is produced by artificial intelligence and is marked with machine-readable metadata identifying it as AI-generated. You are responsible for disclosing the AI-generated nature of content where required by applicable law. Spicy Studio does not guarantee that AI-generated content is free from resemblance to real persons, copyrighted works, or trademarks.

These terms constitute the entire agreement between you and Spicy Studio regarding your use of the Service. If any provision is found to be unenforceable, the remaining provisions will continue in effect.
